Charles Fussell & Co LLP has extensive experience of handling many different types of commercial dispute both on behalf of companies and individuals.  Our expertise includes contractual and tortious claims, and claims based on breaches of trust and fiduciary duty.  We have also acted in property related disputes, joint-venture disputes, regulatory and public law matters.

 

We have a good grasp and understanding of all the relevant substantive and procedural issues that arise in the context of a commercial dispute, including, for example, questions of jurisdiction, governing law and security for costs.

  • Representing the English branch of a US firm in relation to a series of emergency injunctions in England and Florida

 

  • Acting for the former chairman and major shareholder of Queen’s Park Rangers football club in a multi-million pound dispute arising out of the takeover of the club by Flavio Briatore

 

  • Advising the former shareholders and undated bondholders in relation to potential claims arising out of the nationalisation of Bradford & Bingley and their respective rights under the Compensation Order

 

  • Assisting France’s largest daily newspaper in a dispute with a Dutch supplier

 

  • Representing a Romanian distributor against a large multi-national corporation

 

  • Successfully defending four individuals in proceedings brought by the Department of Business, Enterprise and Regulatory Reform under the Company Directors Disqualification Act 1986

 

  • Acting on behalf of a UK charity in relation to a claim brought by a donor for alleged undue influence

 

  • Acting on behalf of an investment advisory firm in relation to a dispute with a number of its investors

 

  • Acting on behalf of an individual in relation to a dispute in relation to unpaid professional fees due following a disposal of a private equity fund’s interest in a corporate entity

 

  • Advising a company in relation to potential claims against an overseas shareholder and third parties, including issues relating to the proper jurisdiction and governing law of the claims

 

  • Acting on behalf of an individual in a claim against a professional trustee arising out of a substantial Jersey-based trust

 

  • Acting for a company seeking to rectify a sale agreement relating to the purchase of a substantial commercial building in London
